These terms apply to your use of smachno.co.uk and consumer purchases made through the website. “Smachno”, “we”, “us” and “our” refer to the business operating this website. Your statutory consumer rights are not affected by these terms.

2 Website use

Use the website lawfully. Do not attempt unauthorised access, introduce malicious software, interfere with security or submit fraudulent orders. If an account is provided, keep your login details secure and notify us of suspected misuse.

Website content belongs to us or our licensors, unless otherwise stated. You may use it for personal browsing and purchasing. Commercial reproduction requires permission unless otherwise permitted by law.

3 Products and food information

Read the product description, ingredients, allergen information, quantity, storage and cooking instructions before ordering. If something is missing or unclear, contact us before purchase.

Images are illustrative, but goods supplied must meet their description. Product-specific information takes precedence over general illustrations. We remain responsible for accurate mandatory food information; asking you to check labels does not remove that responsibility.

Check the delivered label before preparing or consuming food. If it conflicts with the information given at purchase, contact us. Do not consume a product if this creates an allergy or safety concern.

We do not make materially different substitutions without your agreement.

4 Prices and placing an order

Prices are in pounds sterling and include applicable taxes. Any delivery charges and other unavoidable costs are shown before you commit to payment.

Review your order and details before submitting it. Available payment methods are displayed at checkout.

Your order is a request to purchase. A contract is formed when we expressly accept it. An automated message that only acknowledges receipt is not acceptance unless it expressly says so.

If an order cannot be accepted because of unavailable stock, a payment failure, an unsupported delivery address or an obvious error, we notify you and refund any payment taken for it. After acceptance, your contractual and statutory rights apply.

5 Delivery

Available delivery options, charges, areas and any delivery timeframe are provided before purchase. We deliver as agreed or, where no time is agreed, without undue delay and within the legal default period of 30 days unless otherwise agreed.

Provide accurate delivery details and follow the receiving arrangements agreed for your order. Contact us promptly if your address needs correction.

We remain responsible for our chosen delivery provider. Goods normally remain at our risk until you or your nominated recipient physically receives them, subject to any statutory exception.

If delivery is delayed, fails or arrives in an unsafe condition, contact us. Your legal rights to cancellation, replacement or refund remain available where applicable.

6 Storage and safety

Follow the product-specific storage and preparation instructions promptly after delivery. Frozen and chilled foods require appropriate handling.

Do not consume food that appears spoiled, damaged or unsafe. Contact us with the order details and, where available, the batch information.

We are not responsible for deterioration caused solely by incorrect handling after delivery. This does not exclude responsibility for faults present on delivery.

7 Cancellation and refunds

Our Refund Policy explains change-of-mind cancellation, perishable goods and remedies for faulty products. A lawful perishable-goods exception does not remove your rights if goods are unsafe, defective, incorrect or not as described.

Contact us promptly if you want to change or cancel an order before dispatch. We will explain what is possible without reducing any statutory cancellation right.

8 Responsibility and complaints

We are responsible for foreseeable losses caused by our breach of contract. Nothing excludes liability for fraud, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded.

An event outside our reasonable control does not remove your statutory rights concerning delivery, product quality or refunds.

Send complaints to smachno9@gmail.com. We will investigate and explain the proposed resolution. Where legally required, we provide information about an appropriate alternative dispute resolution body and our participation.

9 Changes and applicable law

Changes to these terms apply to future contracts and do not retrospectively change an accepted order without a lawful basis.

Applicable UK law governs consumer purchases. These terms do not choose an exclusive court or remove mandatory protections available where you live. You may use the courts available to you under applicable law.
